Colombia’s Constitutional Court orders prescribed diapers in an individual case

Colombia

Colombia’s Constitutional Court issued judgment T-125/26 on May 8, 2026 in a case concerning an older patient’s access to prescribed care. The court found that Famisanar EPS had not delivered diapers ordered by the treating physician, even though the insurer had supplied some medicines. The court discussed administrative delays alongside the request for home nursing and continuing treatment.

The court partly upheld a September 2025 lower-court ruling as to the supply of diapers and medicines. It ordered Famisanar EPS to provide the required diapers and medicines in line with the treating physician’s instructions within five working days of notification of the judgment. The court separately overturned the lower court’s refusal of home nursing and comprehensive treatment in this case.

In its reasoning, the court referred to earlier case law on medically ordered diapers within Colombia’s health-benefit framework. This judgment addresses one documented patient and does not announce automatic diaper supply for everyone. The published decision does not establish whether the later delivery was completed. WDO has omitted the patient’s identifying and medical details from this report.
